Terms of Service

Hawaii Reggae Network (“we,” “our,” or “us”) provides a free, ad-supported 24/7 reggae radio streaming service through our website, mobile applications, and connected TV applications including the Roku Channel Store (collectively, “the Service”). By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

1. Description of Service

Hawaii Reggae Network is operated by Four Braddahs Media Inc. and provides live streaming radio programming featuring reggae, roots, dub, and island music. The Service includes audio streaming, now-playing song information, album artwork, DJ and show schedule information, and rotating sponsor messages. The Service is available at no cost to users and is supported by sponsor and advertising content.

2. Eligibility

The Service is intended for general audiences. By using the Service, you represent that you are at least 13 years of age. If you are under 18, you represent that you have the consent of a parent or legal guardian to use the Service.

3. User Conduct

You agree not to:

  • Attempt to interfere with, disrupt, or disable any features of the Service, including streaming servers, metadata endpoints, or content delivery systems.
  • Use any automated system, including bots, scrapers, or crawlers, to access the Service for any purpose without our express written permission.
  • Redistribute, rebroadcast, or retransmit any audio content from the Service without prior authorization from Hawaii Reggae Network.
  • Attempt to reverse-engineer, decompile, or extract source code from any of our applications.

4. Intellectual Property

All content delivered through the Service, including but not limited to audio streams, music programming, graphics, logos, trademarks, and application code, is the property of Hawaii Reggae Network, Four Braddahs Media Inc., or our respective licensors. Music streamed through the Service is licensed through our streaming provider, Securenet Systems. You may not copy, reproduce, distribute, or create derivative works from any content provided through the Service.

5. Third-Party Content and Services

The Service may display album artwork, song metadata, and other information sourced from third-party databases and services. Sponsor banners and advertising content displayed within the Service are provided by third-party businesses and do not constitute an endorsement by Hawaii Reggae Network. We are not responsible for the accuracy, content, or practices of any third-party products, services, or websites referenced within the Service.

The Service is distributed on third-party platforms including but not limited to Roku, Amazon, Apple, and Google. Your use of those platforms is subject to their respective terms of service and privacy policies, which are independent of these terms.

6. Availability and Modifications

We strive to maintain 24/7 availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to scheduled maintenance, technical difficulties, network outages, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

We may update these Terms of Service from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised terms.

7. Accounts and Registration

The Service does not require user registration, login credentials, or the creation of an account. No personal information is required to access or use the Service.

8. Advertising and Sponsor Content

The Service displays rotating sponsor banners and promotional content from local and regional businesses. This advertising is delivered as static image content from our own servers and does not involve behavioral tracking, programmatic ad targeting, or the collection of user data for advertising purposes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HAWAII REGGAE NETWORK, FOUR BRADDAHS MEDIA INC., AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless Hawaii Reggae Network, Four Braddahs Media Inc., and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms of Service.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Maui County, Hawaii.

13. Termination

We reserve the right to restrict or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

14. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
